Welcome to the Winston County Courthouse and the Office of the Clerk of the Circuit Court. The Circuit Clerk is the chief administrative and fiscal officer for the court system at the district and circuit court level.

This elected position was established in the Alabama Constitution and has a six year term.

Recent Question Regarding Jury Duty

Section 12-16-8, Code of Alabama

Employees excused from employment; compensation; postponement of service.

(a) Upon receiving a summons to report for jury duty, any employee shall on the next day he is engaged in his employment exhibit the summons to his immediate superior, and the employee shall thereupon be excused from his employment for the day or days required of him in serving as a juror in any court created by the constitutions of the United States or of the State of Alabama or the laws of the United States or of the State of Alabama.

(b) An employee my not be required or requested to use annual, vacation, unpaid leave, or sick leave for time spent responding to a summons for jury duty, time spent participating in the jury selection process, or for time spent actually serving on a jury. Nothing in this subsection shall be construed to require an employer to provide annual, vacation, or sick leave to employees who otherwise are not entitled to the benefits under policies of the employer.

(c) Notwithstanding the excused absence provided in subsection (a) , any fill-time employee shall be entitled to his or her usual compensation received from such employment.

(d) Notwithstanding subsection (a), a court shall automatically postpone and reschedule the service of a summoned juror who is an employee of and employer with five or fewer full-time employees, or their equivalent, if another employee of that employer also has been summoned to appear during the same period. A postponement pursuant to this section shall not affect an individual's right to one automatic postponement under Section 12-16-63.1.

Heartfelt prayers, praises and songs of appreciation streamed from the steps of the Winston County Courthouse as the sun went down on the annual Prayer and Patriotism Ceremony. Speakers and singers left everyone with a greater appreciation for local law enforcement, public servants and those serving in our military. The annual event is a combined effort of public servants, law enforcement agencies, churches and civic organizations.

US Passports Available at the Circuit Clerk's Office
Winston County Residents Can Now Apply for PASSPORT AT THE CIRCUIT CLERK'S OFFICE

Area residents no longer will need to drive to Cullman to apply for a passport. Passport application can now be made at the Winston County Circuit Clerk's office. The process takes about twenty minutes. Persons applying should bring a 2x2 inch color photo (driver's license or State ID) and a certified birth certificate. Children under 16 needing a passport must have one parent present, children under 14 must have both parents present. The cost is $97 for adults, $87 for children. You can expect your passport within 10 weeks. An expedited passport needed in 6 weeks is available for additional $60. Download your form here.
